1. Agreement and business identity
These Terms of Service (the “Terms”) form an agreement between you and the legal entity that operates the All My Houses service and is identified on your checkout, receipt, or invoice (“All My Houses,” “we,” “us,” or “our”). All My Houses is the brand used for the website, account workspace, credit system, and personalized Home Keepsakes (collectively, the “Service”).
By creating an account, purchasing credits, submitting an order, or otherwise using the Service, you agree to these Terms. If you use the Service for a brokerage or other organization, you confirm that you have authority to bind that organization.
2. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into a contract. The Service is intended primarily for real estate professionals, brokerages, and invited team members.
- Provide accurate account and organization information.
- Keep sign-in links and account access confidential.
- Use only the roles and permissions assigned to you.
- Tell us promptly about suspected unauthorized access.
Your organization’s administrator may manage members, billing, and access to orders within its workspace.
3. Credits, prices, and payment
Credits are prepaid units used to order Home Keepsakes. Unless the order screen says otherwise, one credit purchases one standard Home Keepsake. Package quantity, price, currency, taxes, shipping charges, and any package-specific restrictions are shown before purchase.
- Credits have no cash value and cannot be resold.
- Credits may be shared only within the organization that purchased them.
- Any permitted expiry, transfer, or promotional conditions will be clearly disclosed before purchase.
- Payment processing is handled by our payment provider; you authorize the applicable charge when you confirm a purchase.
We may correct obvious pricing or package errors before fulfilling a purchase. If we cannot honour the displayed transaction, we will offer a correction or refund the affected amount.
4. Submitting a personalized order
You are responsible for reviewing the client name, property address, possession date, agent details, delivery information, photographs, and instructions before submitting an order. A credit is redeemed when the order is accepted for production or at the point shown in the order flow.
Contact us immediately if an order needs to change. Because each keepsake is personalized, changes may not be possible after artwork or production begins and may require an additional credit or fee.
5. Photographs, listing content, and client information
You retain ownership of photographs and other content you submit. You grant us a limited, non-exclusive licence to host, crop, trace, adapt, reproduce, and share that content only as needed to create, review, manufacture, deliver, support, and keep required records for your order.
You confirm that you have the rights and permissions needed to use the submitted photograph, listing material, names, addresses, dates, and other personalization details. Do not submit confidential, infringing, misleading, unlawful, or unnecessarily sensitive content.
6. Artwork and natural variation
We translate a photograph into artwork suitable for engraving. Composition, landscaping, shadows, fine architectural details, and typography may be simplified for legibility and production. If a proof is offered, you are responsible for reviewing it within the stated time.
Cherry is a natural material. Grain, colour, tone, knots, engraving contrast, and minor dimensions may vary. These expected variations are not defects. Product images are representative and screen colour is not guaranteed to match the finished wood exactly.
7. Production, delivery, and risk
Production and delivery dates are estimates unless we expressly guarantee a date in writing. Your order confirmation will identify the delivery method, destination, applicable charges, and expected supply date. You are responsible for providing a complete and secure delivery address.
Contact us promptly about a late, lost, damaged, incorrect, or materially defective order. We may ask for photographs or other reasonable information and may repair, replace, re-ship, restore the affected credit, or refund the affected order as appropriate.
8. Cancellations, returns, and refunds
Credit-package and order-specific cancellation or refund terms will be shown before purchase. Personalized goods generally cannot be returned for preference-based reasons after artwork or production has begun. This does not limit rights that cannot lawfully be waived, including applicable rights relating to online sales, non-delivery, incorrect goods, or defective goods.
Email jeff@jeffwebsites.comas soon as possible and include the order or receipt number.
9. Acceptable use
You must not:
- use the Service for unlawful, deceptive, or abusive activity;
- submit content that violates another person’s rights;
- probe, disrupt, reverse engineer, or bypass Service security;
- use automation that places unreasonable load on the Service; or
- sell, rent, or transfer account access without our approval.
10. Our intellectual property
The Service, All My Houses name and logo, site design, software, templates, production methods, and non-customer content are owned by us or our licensors. Except for using the finished keepsake as a gift and using your own submitted content, no rights are granted to copy, modify, distribute, or commercially exploit our materials.
11. Service availability and third parties
We may use payment, hosting, authentication, storage, production, and shipping providers to operate the Service. Their systems may be subject to separate terms. We may update, suspend, or discontinue features when reasonably necessary, including for maintenance, security, legal compliance, or product changes.
12. Disclaimers and limitation of liability
To the extent permitted by law, the Service is provided “as is” and “as available.” We do not promise uninterrupted availability or that every source photograph will produce a particular artistic result.
To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, goodwill, or data. Our aggregate liability relating to a claim will not exceed the amount paid for the credit package or order giving rise to that claim. These limits do not apply where they are prohibited by law or to liability that cannot lawfully be limited.
13. Suspension and termination
We may restrict or suspend access to protect users, investigate misuse, address non-payment, or comply with law. You may stop using the Service at any time. Terms that by their nature should survive—such as payment obligations, licences needed to complete existing orders, intellectual property, disclaimers, and liability provisions—remain in effect.
14. Changes to these Terms
We may update these Terms as the Service or law changes. We will post the updated date and provide additional notice when a change is material. Changes apply prospectively unless law requires otherwise.
15. Governing law and contact
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable there, without limiting mandatory rights available in your home jurisdiction. Courts located in British Columbia will have jurisdiction, unless applicable law requires a different forum.
Questions, notices, or complaints can be sent to jeff@jeffwebsites.com. The operating legal entity and business address for a transaction are identified on the applicable checkout, receipt, or invoice.
